Due diligence mechanism according to the United Nations Guiding Principles for business and human rights: Elements for its on-the-field execution

Abstract

This article analyzes the Due Diligence mechanism according to the Pillar II of the United Nations Guiding Principles on Business and Human Rights, for this we refer to the field of Business & Human Rights, it’s main background in the Universal and Interamerican Systems of Human Rights Protection and the link between the 2030 Agenda. Then, we refer to the concept of due diligence in International Human Rights Law, identifying confluences, divergences, and accuracies when it is used refer to State’s obligations and when it is used refer to Pillar II. Hereunder, we refer the theoretical elements to comprehend the management mechanism of negative impacts on human rights, practical elements, and difficulties for its on-the-field execution. In conclusions we exposed those critical elements that interfere with the effective execution that business must do of this mechanism according to Pillar II.
