Constitutional regulation of the constituent assembly in Latin America

Abstract

When analyzing the fundamental Latin American charters, we identify various formulas for the approval of constitutional reforms. Normally they contemplate aggravated procedures or use participatory mechanisms such as the referendum to ratify the regulations of constitutional rank. However, the phenomenon that recently singles out the approval of new constitutions in this continent is the regulation of the figure of the Constituent Assembly for the total or substantial reform of the fundamental charters.
