The legislative process against judges: the case of inapplicability on procedural grounds
Abstract
This paper describes the main mechanisms to control the constitutionality of the law and its implementation, once it is in force, and analyzes the suitability of such mechanisms to control defective. After analyzing the nature of the errors of form and specific control of constitutionality, the paper concludes that the application is inapplicable on procedural grounds. Finally analyzes the constitutional jurisprudence on the subject and presents some conclusions.
